Use of Access Anaesthetics software is subject to the following terms and conditions.

 

INSTALLATION AGREEMENT

 

Installation of this software indicates acceptance of this agreement. If the terms of this agreement are unacceptable, or you are dissatisfied with this product for any reason, you should cease to use it immediately. You must remove any and all copies of the program from your system.

 

COPYRIGHT

 

The supplied software and documentation are copyrighted products of Hybrid Software Pty Ltd. All rights are reserved, and the use of the software is expressly prohibited, except as authorised by the terms of this agreement. Under no circumstances may you remove the copyright notices which are part of the software or documentation.

 

UNAUTHORISED COPYING

 

Hybrid Software authorises registered users to make archival copies of this software for the sole purpose of back-up and protecting your investment from loss.  Under no other circumstances may you copy the software for the purpose of distribution to others. Copying (except as above), duplicating, selling, renting, transferring, or otherwise distributing the software product is a violation of the law.

 

REGISTRATION

 

Upon installation, the system runs in 'TRIAL' mode which allows creating up to 25 accounts. A unique registration number is required for each authorised installation of the software to advance beyond TRIAL mode. Attempting to bypass the security measures to generate more than 25 accounts is strictly prohibited. Once correctly registered, the "About box" will display the name of the registered user.

 

The registered software may be used for one practice only. The registered user may install the software on other computers (for example, desktop and notebook) provided that the software is for the one practice. Provision for a secretary to operate an additional installation will be allowed according to conditions determined from time to time provided the system is for the sole use of the registered provider of anaesthetic services. Where the software is used for multiple sites, each site should purchase a registered copy of the software.

 

TERMS OF LICENCES

 

The software is licensed to a single practice and may not be transferred to another practice.

A single user version may be used for a single doctor, and cannot be used by another doctor.

Group practices are licensed either for up to 5 providers, or for unlimited providers.

Group practice licences are limited to a single billing group or entity.  Billing groups or entities with unique business names, websites, premises and/or staff, must purchase their own copy of the software.

The software may not be operated on a terminal server without specific approval.

Satellite licenses are for read-only access to a clients data.

 

ANNUAL SUPPORT SUBSCRIPTION

 

Software updates are available only to clients who have paid for an annual support subscription.

Where a client’s support subscription remains unpaid for more than 30 days after the renewal date, a rejoining fee may be charged in addition to the annual renewal fee.

Purchase and subscription prices are posted on our website and may be varied at any time without notice. Additional costs may be levied for disk updates, technical support, training and so on, as listed on our website.

 

DATA LOSS

 

Hybrid Software Pty Ltd bears no responsibility for loss of client data. It is entirely up to the client to make appropriate backups of data to protect again loss. Data files may become corrupted by unexpected disk errors, power outages, computer crashes, network interruptions and other unforseen events. We do not support the use of wireless networks and recommend against these.

 

REFUND

 

If you are unsatisfied with the software for any reason and choose to cease using it within 3 months of purchase, we will refund your purchase price in full.

 

WARRANTY

 

Hybrid Software Pty Ltd has made every effort to ensure that this software is an effective tool for its stated purpose. However, the software is distributed ‘as is’ including any programming errors either known or unknown. To the maximum extent permitted by applicable law, Hybrid Software Pty Ltd makes no warranties relating to this software arising from a failure of this program to operate in the manner desired by the user.

 

DISCLAIMER

 

Neither Hybrid Software Pty Ltd and its employees nor anyone else who has been involved in the creation, production, or delivery of this software shall be liable for any damages including any lost profits, lost savings or other indirect, consequential, or incidental damages arising out of the use or inability to use such software, or any claim by any other party, even if Hybrid Software Pty Ltd has been advised of the possibility of such damages or claims. In no event shall the liability of Hybrid Software Pty Ltd for any damages ever exceed the price paid for the software or the license to use the software, regardless of the form of the claim. The person using the software bears all risk as to the quality and performance of the software.
